Key Assets: Bennett County is genuinely home to LACREEK NATIONAL WILDLIFE REFUGE, a 16,570-acre wetland sanctuary established in 1935 and the only national wildlife refuge in South Dakota headquartered west of the Missouri River; nestled within the shallow Lake Creek valley on the northern edge of the Nebraska Sandhills, the refuge combines native sandhills, sub-irrigated meadows, freshwater marshes, and tall and mixed-grass prairie, serving as a critical staging area for migrating waterfowl, sandhill cranes, shorebirds, and grassland-dependent birds along the Central Flyway – one of only four major migratory bird corridors in North America; more than 282 different bird species have been documented at the refuge since 1959, and it is genuinely one of the few places in South Dakota where visitors might hear both an eastern and a western meadowlark singing from the very same spot; most remarkably, Lacreek played a foundational role in one of American conservation’s great comeback stories: after market hunting for their quills, feathers, and skins, combined with widespread habitat loss, had completely wiped out trumpeter swans from central and eastern North America by the early 1900s, the U.S. Fish and Wildlife Service selected Lacreek in the early 1960s to launch the first trumpeter swan restoration effort anywhere in the Midwest – between 1960 and 1962, 57 cygnets were carefully transported from Red Rock Lakes National Wildlife Refuge in Montana, at the time the largest trumpeter swan reintroduction effort ever attempted; the effort succeeded remarkably: by 1964, the first successful trumpeter swan nest in almost a century was documented near Valentine, Nebraska, and the descendants of those original Lacreek swans are found today throughout the Central Flyway as the “High Plains Flock,” with winter counts at the refuge itself reaching as high as 500 birds in January 2022; the refuge also hosts a dedicated Prairie Grouse Viewing Blind, allowing visitors each spring to observe the elaborate mating dances (“leks”) of native prairie grouse

Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.

Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Bennett County, along with the original will if one exists.
