About Minnehaha County
Minnehaha County is Sioux Falls – a city whose economic profile is wildly disproportionate to its size and whose story involves one of the most consequential pieces of financial legislation in American banking history.
In 1980, South Dakota eliminated its usury laws – the legal caps on interest rates that banks could charge – making it the first state to do so following the Supreme Court’s 1978 Marquette National Bank decision that allowed banks to export their home state’s interest rate rules to customers nationwide. Citibank seized the opportunity immediately, relocating its credit card operations from New York to Sioux Falls in 1981. Other major banks followed. Today, Sioux Falls is home to the credit card and consumer lending operations of Citibank, Wells Fargo, USAA, Great Plains Energy, and dozens of other financial institutions – making it one of the most significant financial services centers in the United States relative to its population. The banking sector employs tens of thousands in Minnehaha County and has generated the wealth that funds the city’s remarkable quality of life.
Sanford Health – one of the largest rural health systems in the United States, headquartered in Sioux Falls – is Minnehaha County’s largest employer and a dominant force in healthcare across a vast swath of the northern Great Plains. The appeal process:
If you disagree with your assessed value, appeal to the Minnehaha County Director of Equalization informally first. For a formal appeal, file with the Minnehaha County Board of Equalization by the third Tuesday in March of the assessment year. The Board holds hearings and issues written decisions.
If unsatisfied, appeal to the South Dakota Office of Hearing Examiners and then to the South Dakota Circuit Court.
Senior Freeze: South Dakota’s Assessment Freeze for the Elderly and Disabled program freezes the assessed value of a qualifying senior’s home – preventing increases from driving up tax bills. To qualify: age 70+ (or disabled), income at or below $40,600 (2025 – confirm current threshold), and must have owned and occupied the property for at least three years. Apply through the Minnehaha County Director of Equalization by April 1.

Minnehaha County was created April 5, 1862 and organized in 1868, named for the “rapid water” of the Big Sioux River falls, in southeastern South Dakota, seated in Sioux Falls – the state’s most populous county and largest city.
Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. The affidavit only transfers personal property – real estate requires a separate affidavit (also usable when all SD real estate is under $50,000), which must additionally be filed with the Register of Deeds in the county where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along, there are no creditor disputes, and no trouble is expected. The process begins by filing an application with the court to serve as personal representative.
Unsupervised Formal Probate and Supervised Formal Probate – used for more complex, contested, or higher-oversight situations; South Dakota, like other UPC states, offers all three levels.
Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Minnehaha County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings (unsupervised or supervised) require notice to interested parties and, if contested, a hearing before the circuit judge.
The personal representative gathers and inventories assets, notifies creditors, and pays valid debts and expenses.
After debts and taxes are satisfied, remaining assets are distributed to heirs or beneficiaries according to the will or South Dakota’s intestacy statutes (SDCL Chapter 29A-2).
The estate is formally closed by filing a sworn closing statement or a petition for formal order of discharge (SDCL § 29A-3-1003).
