About Pennington County
Pennington County is home to Rapid City – the commercial, cultural, and governmental hub of western South Dakota and the northern Great Plains, and the gateway to one of America’s most extraordinary concentrations of natural and cultural landmarks.
Mount Rushmore National Memorial – the carved granite faces of Washington, Jefferson, Theodore Roosevelt, and Lincoln rising 60 feet above the Black Hills – is South Dakota’s defining icon and one of the most recognized images in American history. Sculptor Gutzon Borglum began carving in 1927; the project was largely completed by 1941 at a total cost of approximately $1 million (funded primarily by federal appropriations). Mount Rushmore draws approximately 3 million visitors annually and is the economic engine of the entire Black Hills region.
The Crazy Horse Memorial – a private, non-profit effort begun in 1948 by sculptor Korczak Ziolkowski and now continued by his family – is carving a tribute to Oglala Lakota warrior Crazy Horse from the adjacent mountain. When complete, Crazy Horse will dwarf Rushmore; the face alone was unveiled in 1998 and is 87 feet tall. The project continues without federal funding by deliberate choice of the Ziolkowski family.
Custer State Park – one of the largest state parks in the United States – protects 71,000 acres of Black Hills ponderosa pine forest, meadows, and granite formations, home to one of the largest free-roaming American bison herds in the world (approximately 1,300 animals). The Needles Highway and Iron Mountain Road are among the most spectacular mountain drives in America.
Ellsworth Air Force Base – home of the 28th Bomb Wing operating the B-21 Raider (the Air Force’s newest stealth bomber, which began arriving at Ellsworth in 2023) and previously the B-1B Lancer – is one of the most strategically significant bomber bases in the Air Force inventory and a major Pennington County employer.
Rapid City (population ~80,000) has a vibrant downtown anchored by the Presidents Park (life-size bronze statues of all US presidents lining the streets), the Dahl Arts Center, and a craft brewery scene. The city is the regional healthcare, retail, and professional services hub for a vast catchment area extending into Wyoming, Nebraska, and Montana.

The appeal process:
File an appeal with the Pennington County Board of Equalization by the third Tuesday in March. If unsatisfied, appeal to the South Dakota Office of Hearing Examiners and then to the South Dakota Circuit Court.
Senior Assessment Freeze: Qualifying homeowners age 70+ with household income at or below $40,600 (2025) who have owned and occupied the property for at least three years may have their assessed value frozen. Apply through the Director of Equalization by April 1.

Pennington County was created January 11, 1875 and organized April 19, 1877, named for John L. Pennington, in the Black Hills of western South Dakota, seated in Rapid City – the state’s second most populous county. The 1922 Pennington County Courthouse, Beaux Arts in style, is listed on the National Register of Historic Places.
Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. A separate affidavit exists for South Dakota real estate under $50,000, which must also be filed with the Register of Deeds where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along and no disputes are expected.
Unsupervised Formal Probate and Supervised Formal Probate – for more complex or contested situations.
Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Pennington County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings require notice to interested parties and, if contested, a hearing before the circuit judge.
The personal representative gathers and inventories assets, notifies creditors, and pays valid debts and expenses.
After debts and taxes are satisfied, remaining assets are distributed according to the will or South Dakota’s intestacy statutes (SDCL Chapter 29A-2).
The estate is formally closed by filing a sworn closing statement or a petition for formal order of discharge (SDCL § 29A-3-1003).

South Dakota has NO state estate tax and NO state inheritance tax. Only the federal estate tax may apply, and only to very large estates.
