Potter County, South Dakota
Gettysburg and Lake Oahe walleye fishing - from Gettysburg's position along Lake Oahe (the massive Missouri River reservoir stretches along Potter County's western edge, providing some of the finest walleye fishing in the Great Plains and drawing anglers from across the region to the county's lake access points and boat ramps) to the county's agricultural and ranching landscape (Potter County's gently rolling mixed-grass prairie supports wheat, corn, and cattle operations across north-central South Dakota between the Missouri River reservoir system and the James River valley).

Key Assets: Potter County’s seat, Gettysburg, carries a genuinely charming piece of only-in-America naming history – the town was founded in 1883 by a group of Union Army Civil War veterans who deliberately chose their new prairie home’s name to honor the famous battle many of them had fought in; the founders initially wanted to name the town “Meade,” in honor of General George Meade, the Union commander credited with leading the actual Battle of Gettysburg to victory, but the U.S. Post Office rejected that name for being already too common; Captain John W. Kennedy, a veteran who had personally served in General Howard’s 11th Corps during the real Battle of Gettysburg, then proposed the name “Gettysburg” directly instead, and the Post Office accepted it; remarkably, 108 years later, Gettysburg, South Dakota formally became “sister cities” with Gettysburg, Pennsylvania in recognition of their shared namesake and heritage – and true to its founding irony, the South Dakota town proudly carries the nickname “Where the Battle Wasn’t”; the town’s earliest buildings were genuinely modest by any standard – local history records that the very first structures in Gettysburg consisted of nothing more than two tents (a small “wedge tent” and a slightly larger 8×10-foot “wall tent” considered a luxury at the time) and a covered wagon known as a Prairie Schooner; visitors today can also explore the genuinely historic 1911 Potter County Courthouse, a Classical Revival building whose location itself was hard-won – Gettysburg secured the county seat only after a bitter dispute with rival town Forest City, which initially refused to surrender the official county papers, reportedly requiring a raid led by future South Dakota governor Frank M. Byrne to finally retrieve them
Notes: Gettysburg’s genuine, well-documented naming story – Civil War veterans naming their new prairie town for the battle many had personally fought – combined with the town’s real “Where the Battle Wasn’t” nickname, makes for one of the most charmingly self-aware local histories found anywhere in this project.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Clerk of Courts, Potter County 201 South Exene Street, Gettysburg, SD 57442 (605) 765-9482 Potter County is in north-central South Dakota, seated in Gettysburg.
Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. A separate affidavit exists for South Dakota real estate under $50,000, which must also be filed with the Register of Deeds where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along and no disputes are expected.
Unsupervised Formal Probate and Supervised Formal Probate – for more complex or contested situations.
Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Potter County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings require notice to interested parties and, if contested, a hearing before the circuit judge.
The personal representative gathers and inventories assets, notifies creditors, and pays valid debts and expenses.
After debts and taxes are satisfied, remaining assets are distributed according to the will or South Dakota’s intestacy statutes (SDCL Chapter 29A-2).
The estate is formally closed by filing a sworn closing statement or a petition for formal order of discharge (SDCL § 29A-3-1003).
What it costs
Court costs are set by law and paid to the Clerk of Courts; confirm current fees with Potter County directly.
South Dakota has NO state estate tax and NO state inheritance tax. Only the federal estate tax may apply, and only to very large estates.
A surviving spouse cannot be disinherited in South Dakota unless the spouse agrees.
