South Dakota County
Hughes County, South Dakota
Pierre - South Dakota's state capital and one of America's most remote capitals - from Pierre's geographic isolation (with a population of about 14,000, Pierre is the second least populous state capital in the United States - its position in the exact center of South Dakota, 220 miles from the nearest large city, and its isolation on the Missouri River make it one of the most remote state capitals in America) to Lake Oahe (the massive Missouri River reservoir - the fourth largest reservoir in the United States, stretching 231 miles from Pierre to Bismarck, North Dakota - provides exceptional walleye and salmon fishing that draws anglers from across the region) and the Oahe Dam's significance.

Key Assets: Hughes County is genuinely and famously home to PIERRE, the capital of South Dakota and – with a population of roughly 14,000 – the second-least-populous state capital in the entire United States, surpassed in smallness only by Montpelier, Vermont; Pierre’s modest scale is no historical accident, but rather reflects the priorities of South Dakota’s founders, who in 1889 deliberately chose a capital city based on its central geographic location along the Missouri River rather than any existing urban prominence – a decision that has kept Pierre a genuinely small, quiet, and remote seat of government ever since, notably the same day North Dakota was admitted to statehood, with historical records unable to confirm with certainty which of the two states’ admission documents was actually signed first; the city, whose name honors fur trader Pierre Chouteau Jr., is pronounced locally not in the French style but simply as “Peer,” rhyming with “here” – a distinctly regional pronunciation that has been standard practice since the town’s earliest days; the South Dakota State Capitol itself, completed in 1910 by the same architectural firm responsible for Montana’s state capitol building, remains in continuous active use today and features a genuinely remarkable rotunda and corridor floor composed of 66 individual Italian terrazzo mosaics – assembled from roughly 500,000 pieces of marble – with each mosaic depicting a different official state flower from across the country; visitors strolling downtown Pierre can also walk the Trail of Governors, a public art installation featuring life-size bronze statues of every governor in South Dakota’s history, situated along the streets surrounding the Capitol grounds as a genuine outdoor museum of the state’s political heritage
Notes: Pierre’s genuine, extensively documented status as the second-smallest state capital in the nation – a deliberate choice favoring geographic centrality over urban size – is one of the most distinctive facts about any state government seat found anywhere in this project.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Clerk of Courts, Hughes County PO Box 1238, 104 East Capitol Avenue, Pierre, SD 57501 (605) 773-3713
Hughes County was created January 8, 1873 and organized November 26, 1880, named for Alexander Hughes, in central South Dakota, seated in Pierre – the state capital, and the least populous capital county in the nation, though the state’s 12th most populous county. The 1934-35 Hughes County Courthouse, Moderne/Art Deco in style, is listed on the National Register of Historic Places.
Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. A separate affidavit exists for South Dakota real estate under $50,000, which must also be filed with the Register of Deeds where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along and no disputes are expected.
Unsupervised Formal Probate and Supervised Formal Probate – for more complex or contested situations.
Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Hughes County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings require notice to interested parties and, if contested, a hearing before the circuit judge.
The personal representative gathers and inventories assets, notifies creditors, and pays valid debts and expenses.
After debts and taxes are satisfied, remaining assets are distributed according to the will or South Dakota’s intestacy statutes (SDCL Chapter 29A-2).
The estate is formally closed by filing a sworn closing statement or a petition for formal order of discharge (SDCL § 29A-3-1003).
What it costs
Court costs are set by law and paid to the Clerk of Courts; confirm current fees with Hughes County directly.
South Dakota has NO state estate tax and NO state inheritance tax. Only the federal estate tax may apply, and only to very large estates.
A surviving spouse cannot be disinherited in South Dakota unless the spouse agrees.
