Virginia County
Isle of Wight County, Virginia
Smithfield ham and Isle of Wight James River heritage - from Smithfield's world-famous ham (Smithfield, the county's largest town, is the home of Smithfield Foods and the birthplace of the genuine Smithfield ham - by Virginia law, a true Smithfield ham must be cured within the Smithfield city limits, giving this small James River town a globally recognized culinary identity) to Isle of Wight County's colonial James River heritage (the county was established in 1634 as one of Virginia's original eight shires, making it one of the oldest counties in the United States, with colonial-era landmarks and historic churches along the James River reflecting centuries of continuous settlement).

Parks & Recreation
PARKS & RECREATION
Key Assets: The Isle of Wight County Museum in Smithfield, founded in 1976 and originally housed in the historic 18th-century Gaming House, is home to the World’s Oldest Edible Ham – a hog cured in 1902 by P.D. Gwaltney Jr., accidentally left hanging in a packing house for 20 years, then displayed in an iron safe from 1924 onward and advertised as the world’s oldest Smithfield ham; the ham has been featured in Ripley’s Believe It or Not! (1929, 1932, 2003) and even has its own live “Ham Cam” so remote visitors can check on it 24/7; the museum also holds the World’s Oldest Peanut (from 1890, 3D-scanned by Virginia Commonwealth University and freely downloadable for printing), plus fossils, Native American and colonial artifacts, and a Cold War-era fallout shelter built into a former bank vault; genuine Smithfield ham itself is legally defined and protected by a Virginia General Assembly statute (originally 1926, updated 1966) – a true Smithfield ham must be dry-salt cured and aged a minimum of six months entirely within Smithfield town limits
Notes: This is a genuinely unusual and verified regional landmark, not exaggerated marketing – the World Record Academy recognizes the Gwaltney ham as the actual world record holder for oldest edible cured ham. Admission to the museum is low-cost (around $2 per the most recent reports) – confirm current hours and admission directly.

NOTES
Isle of Wight County is genuinely home to one of Virginia’s most delightfully unusual verified attractions – the World’s Oldest Edible Ham, a 1902 cured Smithfield ham on permanent display (with its own live webcam) at the Isle of Wight County Museum. The county’s Smithfield ham heritage isn’t just tourism marketing either – it’s legally codified in Virginia state law, defining exactly what qualifies as a “genuine Smithfield ham.” All contact information above was sourced from official county and museum pages as of this writing; phone numbers and hours should be reconfirmed directly with the relevant office before a visit.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Isle of Wight Circuit Court 17000 Josiah Parker Circle, 2nd Floor, PO Box 110, Isle of Wight, VA 23397 (757) 356-1978
Isle of Wight County is in Southeast Virginia’s Hampton Roads region, one of Virginia’s original 1634 shires, county seat Isle of Wight. Virginia has NO separate probate court – probate (“qualification”) is handled entirely by the Circuit Court Clerk’s Office.
Step 1: figure out which path applies
Virginia calls the probate process “qualification” rather than “appointment,” and it happens administratively at the Circuit Court Clerk’s Office, not before a judge, unless a dispute arises.
Small Estate Affidavit (Va. Code § 64.2-601, the “Virginia Small Estate Act”) – available when the decedent’s entire personal probate estate (excluding real estate) does not exceed $75,000, at least 60 days have passed since death, and no personal representative has been appointed or has a pending application in any jurisdiction. If a will exists, it must first be admitted to probate (recorded with the Clerk) even though no executor is appointed. As of July 1, 2026, the affidavit must be filed on the statewide form (CC-1685).
Single Small Asset Release (Va. Code § 64.2-602) – any person or institution holding a single asset of $35,000 or less may release it directly to a successor once 60 days have passed since death and no personal representative has qualified, without any affidavit required at all.
Real Estate Affidavit (Form CC-1612) – if the decedent owned only real estate, this can be recorded directly in land records without full probate. Real estate generally cannot be transferred through the small estate affidavit process.
Full Qualification / Administration – the standard path for larger or more complex estates. The personal representative appears before the Clerk, takes an oath, files the will and death certificate, and typically posts a surety bond. The estate is then supervised by a Commissioner of Accounts throughout administration.
Step 2: filing for administration
The person seeking to qualify as executor or administrator brings the original will (if any) and a certified death certificate to the Isle of Wight Circuit Court Clerk’s Office.
The Clerk reviews the will’s validity and admits it to probate.
The personal representative takes an oath and qualifies, posting a bond if required; the Clerk issues Letters Testamentary or Letters of Administration.
The Commissioner of Accounts oversees the estate going forward.
The personal representative notifies creditors, pays valid debts, and manages estate assets.
Remaining assets are distributed to beneficiaries or heirs, and the estate is closed once final accounting is approved.
What it costs
Virginia imposes a PROBATE TAX on most wills admitted to probate and grants of administration: $1 state tax + $0.33 local tax for every $1,000 of estate value. No tax is imposed on estates valued at $15,000 or less.
Filing fees for qualification vary by estate size; confirm current Isle of Wight County fees directly.
Virginia does NOT impose a state estate tax or inheritance tax – repealed for deaths on or after July 1, 2007. Only the federal estate tax may apply, and only to very large estates.
