Virginia County
Middlesex County, Virginia
Rappahannock River and Chesapeake Bay watermen heritage - from Middlesex County's extensive Rappahannock River and Chesapeake Bay shoreline (the county occupies a peninsula between the Rappahannock River and the Piankatank River, with significant Chesapeake Bay frontage that has supported generations of commercial watermen harvesting blue crabs, oysters, and striped bass in some of the Bay's most productive waters) to Deltaville (one of the Chesapeake Bay's most celebrated boating and sailing communities, Deltaville at the tip of the Middle Peninsula has been a hub for wooden boat building, marina services, and Bay sailing culture for over a century).

Office: Middlesex County Department of Emergency Services – Cooks Corner Office Complex, 2893 General Puller Hwy, Saluda, VA 23149
Notes: Middlesex County serves approximately 10,000 citizens but has only about 30 first responders available to assist in a major disaster – the county’s own emergency services page states this directly as a reason for residents to actively prepare rather than assume rapid response. Public meetings are held quarterly, 6:00 PM the 4th Tuesday of January, April, July, and October.

Notes: This is genuinely one of only seven fully independent (non-regional) public libraries left in Virginia. Its roots trace to 1915, when 15 local women formed a book-exchange club; a WPA-funded library briefly operated in Deltaville during the 1930s-40s out of a local grocery store; the Urbanna and Deltaville libraries formally merged in 1987 to form MCPL as a 501(c)(3) nonprofit. A 1990s Capital Fund Campaign raised over $700,000 from public donations, individual pledges, and government grants to build the current Urbanna branch and renovate the Deltaville facility, both opening in 1993; MCPL hired its first certified librarian in 1994.
Parks & Recreation
PARKS & RECREATION
Key Assets: Middlesex County was formed from Lancaster County in 1673, named after a county in England; European settlement began around 1640, though Algonquian-speaking tribes of the Powhatan Confederacy had inhabited the area for thousands of years prior; the Middlesex County Courthouse in Saluda, built 1850-1874 by architects William R. Jones and John P. Hill, is listed on the National Register of Historic Places; Deltaville is genuinely known as the “Boating Capital of the Chesapeake,” home to marinas, fishing charters (striped bass, flounder), and sailing instruction through organizations like the Fishing Bay Yacht Club
Notes: With over 100 miles of shoreline in a 130-square-mile county, Middlesex is a genuine water-recreation destination – osprey nesting sites are commonly visible along the riverfront for wildlife viewing

NOTES
Middlesex County, formed in 1673, is a genuine Chesapeake Bay water community where Deltaville has earned its reputation as the “Boating Capital of the Chesapeake.” The county’s independent public library – one of only seven remaining independent library systems in Virginia – traces its history to a 1915 ladies’ book-exchange club, a real grassroots origin story. The county’s own emergency services office is refreshingly direct that only about 30 first responders serve roughly 10,000 residents in a major disaster, a genuinely important fact for residents’ own emergency preparedness planning. All contact information above was sourced from official county and library pages as of this writing; phone numbers and hours should be reconfirmed directly with the relevant office before a visit.
About Middlesex County
Middlesex County is the Middle Peninsula’s Rappahannock River and Deltaville sailing county – centuries of Chesapeake Bay watermen heritage and Deltaville’s celebrated boating culture define a county whose riverside and bay shore communities maintain one of Virginia’s most authentic Tidewater maritime identities.
Saluda (the county seat, population ~2,500) is Middlesex County’s governmental and commercial hub, a small Tidewater town on the Rappahannock River providing county services to the surrounding Middle Peninsula communities.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Middlesex Circuit Court 73 Bowden Street, PO Box 158, Saluda, VA 23149 (804) 758-5317
Middlesex County is on Virginia’s Middle Peninsula, county seat Saluda. Virginia has NO separate probate court – probate (“qualification”) is handled entirely by the Circuit Court Clerk’s Office, an elected constitutional officer serving an eight-year term with authority to probate wills, grant administration of estates, and appoint guardians.
Step 1: figure out which path applies
Virginia calls the probate process “qualification” rather than “appointment,” and it happens administratively at the Circuit Court Clerk’s Office, not before a judge, unless a dispute arises.
Small Estate Affidavit (Va. Code § 64.2-601, the “Virginia Small Estate Act”) – available when the decedent’s entire personal probate estate (excluding real estate) does not exceed $75,000, at least 60 days have passed since death, and no personal representative has been appointed or has a pending application in any jurisdiction. If a will exists, it must first be admitted to probate (recorded with the Clerk) even though no executor is appointed. As of July 1, 2026, the affidavit must be filed on the statewide form (CC-1685).
Single Small Asset Release (Va. Code § 64.2-602) – any person or institution holding a single asset of $35,000 or less may release it directly to a successor once 60 days have passed since death and no personal representative has qualified, without any affidavit required at all.
Real Estate Affidavit (Form CC-1612) – if the decedent owned only real estate, this can be recorded directly in land records without full probate. Real estate generally cannot be transferred through the small estate affidavit process.
Full Qualification / Administration – the standard path for larger or more complex estates. The personal representative appears before the Clerk, takes an oath, files the will and death certificate, and typically posts a surety bond. The estate is then supervised by a Commissioner of Accounts throughout administration.
Step 2: filing for administration
The person seeking to qualify as executor or administrator brings the original will (if any) and a certified death certificate to the Middlesex Circuit Court Clerk’s Office.
The Clerk reviews the will’s validity and admits it to probate.
The personal representative takes an oath and qualifies, posting a bond if required; the Clerk issues Letters Testamentary or Letters of Administration.
The Commissioner of Accounts oversees the estate going forward.
The personal representative notifies creditors, pays valid debts, and manages estate assets.
Remaining assets are distributed to beneficiaries or heirs, and the estate is closed once final accounting is approved.
What it costs
Virginia imposes a PROBATE TAX on most wills admitted to probate and grants of administration: $1 state tax + $0.33 local tax for every $1,000 of estate value. No tax is imposed on estates valued at $15,000 or less.
Filing fees for qualification vary by estate size; confirm current Middlesex County fees directly.
Virginia does NOT impose a state estate tax or inheritance tax – repealed for deaths on or after July 1, 2007. Only the federal estate tax may apply, and only to very large estates.
