Notes: Nelson County has genuinely significant flood-disaster history – on the night of August 19-20, 1969, Hurricane Camille’s remnants dropped an estimated 27-31 inches of rain on the county in under 12 hours, triggering catastrophic flash flooding and mudslides that killed 111-125 people in Nelson County alone (Virginia’s overall death toll was 124), making it one of the deadliest natural disasters in Virginia’s recorded history. A granite marker on the historic courthouse lawn memorializes the lives lost. This history is directly relevant to the county’s ongoing flood-risk awareness – Congress recently advanced the Wintergreen Emergency Egress Act, which would fund a dedicated emergency escape road connecting Wintergreen Resort to the Blue Ridge Parkway specifically for use during natural disasters like wildfires, a live legislative effort as of this writing.

Notes: This library is genuinely a living memorial – it is explicitly dedicated to the memory of Nelson County’s Hurricane Camille victims, with funding for its internet service and other programs historically supported in part by the Torn Land Memorial Trust Fund (named for the 1970 book “Torn Land” documenting the disaster). The current building opened in 1988 after a community-driven fundraising and construction effort beginning in 1983. The Nelson County Visitor Center operates on the library’s lower level, and the Nelson County Historical Society maintains local history and cemetery records there as well.
Parks & Recreation
PARKS & RECREATION
Key Assets: Nelson County is a major Blue Ridge outdoor recreation destination – Crabtree Falls, the highest cascading waterfall east of the Mississippi River, plus fishing on the Tye River, James River, Piney River, and Lake Nelson; 11 watchable-wildlife loops recognized by the Virginia Birding and Wildlife Trail program; Wintergreen Resort, a four-season destination for skiing, golf, mountain biking, and spa services; the county has more wineries, breweries, cideries, and distilleries per square mile than anywhere else in the Mid-Atlantic, including the first Scottish-style whisky distillery in America; over 40 varieties of apples and peaches are grown in local orchards, with spring blossom displays and weekend autumn harvest festivals; the scenic 50-mile Nelson Scenic Loop (Route 151, Route 664, the Blue Ridge Parkway, and Route 56) connects many of these attractions
Notes: Route 151 near Devil’s Backbone Brewery can become difficult in bad weather – locals specifically caution against certain GPS-suggested mountain shortcuts. Four-wheel drive is a smart consideration for winter visits to Wintergreen.

Animal Services
ANIMAL SERVICES
Office: Nelson County Animal Control – 84 Courthouse Square, P.O. Box 336, Lovingston, VA 22949 | (434) 263-7015 or 888-662-9400 | Adoption info: (434) 263-7047
Adoption fees: $70 for dogs, $65 for cats, including spay/neuter, first deworming, and first vaccination round including rabies
Notes: Stray dogs and cats are NOT picked up after hours unless involved in an attack or severely injured – the county advises leaving a found stray alone if possible, since interacting with strays carries disease/safety risk and most animals are found close to home. IMPORTANT: animals are legally considered property in Virginia – taking a stray out of the county where it was found, or failing to report a stray you take in to Animal Control, can result in theft charges. The independent Humane Society/SPCA of Nelson County, 29 Stagebridge Road, Lovingston, VA, (434) 263-7722, open daily 11 AM–6 PM, is a separate no-kill organization that also evaluates and adopts out unclaimed animals from the county Animal Control facility – no animal is put down there unless dangerously aggressive or untreatably ill. A separate “Almost Home SPCA” in Lovingston is explicitly NOT affiliated with the county and does not respond to Animal Control matters, though it remains a community resource.

NOTES
Nelson County carries genuinely profound disaster history – the catastrophic 1969 Hurricane Camille flooding that killed well over 100 residents remains a defining chapter of local memory, honored today through the Nelson Memorial Library itself, built as a living memorial to those lost. That history sits alongside the county’s present identity as a premier Blue Ridge outdoor and agritourism destination, home to Wintergreen Resort, Crabtree Falls, and the densest concentration of wineries and distilleries in the Mid-Atlantic. All contact information above was sourced from official county and library pages as of this writing; phone numbers and hours should be reconfirmed directly with the relevant office before a visit.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Nelson Circuit Court 84 Courthouse Square, 1st Floor, PO Box 10, Lovingston, VA 22949 (434) 263-7027
Nelson County is in Central Virginia near the Blue Ridge Mountains, county seat Lovingston. Virginia has NO separate probate court – probate (“qualification”) is handled entirely by the Circuit Court Clerk’s Office.
Step 1: figure out which path applies
Virginia calls the probate process “qualification” rather than “appointment,” and it happens administratively at the Circuit Court Clerk’s Office, not before a judge, unless a dispute arises.
Small Estate Affidavit (Va. Code § 64.2-601, the “Virginia Small Estate Act”) – available when the decedent’s entire personal probate estate (excluding real estate) does not exceed $75,000, at least 60 days have passed since death, and no personal representative has been appointed or has a pending application in any jurisdiction. If a will exists, it must first be admitted to probate (recorded with the Clerk) even though no executor is appointed. As of July 1, 2026, the affidavit must be filed on the statewide form (CC-1685).
Single Small Asset Release (Va. Code § 64.2-602) – any person or institution holding a single asset of $35,000 or less may release it directly to a successor once 60 days have passed since death and no personal representative has qualified, without any affidavit required at all.
Real Estate Affidavit (Form CC-1612) – if the decedent owned only real estate, this can be recorded directly in land records without full probate. Real estate generally cannot be transferred through the small estate affidavit process.
Full Qualification / Administration – the standard path for larger or more complex estates. The personal representative appears before the Clerk, takes an oath, files the will and death certificate, and typically posts a surety bond. The estate is then supervised by a Commissioner of Accounts throughout administration.
Step 2: filing for administration
The person seeking to qualify as executor or administrator brings the original will (if any) and a certified death certificate to the Nelson Circuit Court Clerk’s Office.
The Clerk reviews the will’s validity and admits it to probate.
The personal representative takes an oath and qualifies, posting a bond if required; the Clerk issues Letters Testamentary or Letters of Administration.
The Commissioner of Accounts oversees the estate going forward.
The personal representative notifies creditors, pays valid debts, and manages estate assets.
Remaining assets are distributed to beneficiaries or heirs, and the estate is closed once final accounting is approved.
What it costs
Virginia imposes a PROBATE TAX on most wills admitted to probate and grants of administration: $1 state tax + $0.33 local tax for every $1,000 of estate value. No tax is imposed on estates valued at $15,000 or less.
Filing fees for qualification vary by estate size; confirm current Nelson County fees directly.
Virginia does NOT impose a state estate tax or inheritance tax – repealed for deaths on or after July 1, 2007. Only the federal estate tax may apply, and only to very large estates.
