Notes: Essex County is genuinely home to some of the nation’s oldest jails: the first jail in the United States began operation in Salem in 1638 – a series of wooden structures that stood through 1813, spanning the entire era of the 1692 Salem Witch Trials – before being replaced by a stone jail in 1813. Lawrence’s jail, built in 1853 with 116 cells, was the nation’s second-oldest. Both facilities were retired in the late 1980s.

Massachusetts property tax is assessed at the municipal level by each city and town’s own assessor at 100% of full and fair cash value as of January 1 each year. There is no county assessor and no county tax. Essex County’s 34 municipalities each set their own tax rates, creating significant variation across the county – affluent coastal towns like Manchester-by-the-Sea and Rockport often have lower rates (due to high property values spreading the levy across a large base) while cities like Lawrence and Lynn have higher rates relative to property values.
Massachusetts assesses at 100% of market value – no assessment ratio. The Department of Revenue certifies assessments every three years (triennial certification) and requires full revaluations on a 9-year cycle with statistical updates in between.
The abatement (appeal) process:
File an abatement application (State Tax Form 128) with your local city or town assessor within 30 days of the mailing of the third-quarter actual tax bill – typically January 2 through February 1. Find your assessor at your town hall. Late applications are virtually always denied. If the assessor denies your application or the reduction is insufficient, appeal to the Massachusetts Appellate Tax Board (ATB) within 3 months of the assessor’s decision. ATB: 100 Cambridge Street, Suite 200, Boston (617-727-3100). If your real estate tax exceeds $5,000, your payment must be physically in the tax collector’s hands by the bill’s due date – a postmark is not sufficient – to preserve ATB appeal rights.
Massachusetts limits total municipal tax levy growth to 2.5% annually plus new growth (Proposition 2½) – but individual bills can still rise if assessed values increase or if local rates shift within that levy limit.
Senior exemptions (Clause 41C): Qualifying homeowners 65 or older with income and assets below the statutory threshold receive a dollar reduction in property taxes. Base amount: $500, but municipalities may vote a higher local amount. Apply with your local assessor by April 1 annually. Clause 41A tax deferral allows qualifying seniors to defer all property taxes until sale or transfer.
OWNWELL CTA: Essex County’s abatement window is 30 days from the third-quarter actual tax bill – typically February 1. Each of the 34 towns has its own process and assessor. Ownwell manages the abatement process with no upfront cost.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Essex Probate and Family Court 36 Federal Street, Salem, MA 01970 (978) 744-1020
Essex County is in northeastern Massachusetts, seated in Salem, with an additional full-time session in Lawrence.
Step 1: figure out which path applies
Massachusetts adopted a version of the Uniform Probate Code (the Massachusetts Uniform Probate Code, or MUPC), codified largely at Mass. Gen. Laws c. 190B.
Voluntary Administration – the simplest path, for estates consisting entirely of personal property valued at $25,000 or less (not counting one motor vehicle). The decedent must have been a Massachusetts resident with no real estate solely in their name, at least 30 days must have passed since death, and no formal or informal probate petition can be pending. Filed using the Voluntary Administration Statement (Form MPC 170) – the filer becomes the Voluntary Personal Representative with no court hearing required. Filing fee is $115.
Informal Probate – the standard track for most straightforward estates, whether the estate has a will or not. A Magistrate reviews the petition administratively; an informal probate order can issue within about 7 days of filing, though the full case (including the required waiting and notice periods) typically closes in roughly 9 to 14 months.
Formal Probate – required when the will is contested, there’s uncertainty about who should serve as personal representative, or other disputes require a judge’s decision after a hearing.
Summary Administration – under c. 190B §3-1203, available when the estate’s value doesn’t exceed the family allowance, exempt property, funeral expenses, and expenses of the last illness – allows the personal representative to distribute the estate immediately without notifying creditors.
Step 2: filing for probate
Determine which track fits: gather the death certificate, will (if any), and a rough inventory of assets to see whether Voluntary Administration, Informal, or Formal Probate applies.
File the appropriate petition with the Probate and Family Court in the county where the decedent resided.
For informal proceedings, the Magistrate reviews and, if in order, appoints the personal representative and issues Letters without a hearing.
The personal representative gathers assets, provides required notices, pays valid debts and taxes, and distributes what remains to the heirs or beneficiaries – Massachusetts generally requires estates be probated within 3 years of death.
What it costs
Voluntary Administration filing fee: $115.
Informal and formal probate filing fees vary by estate type and are set by the Trial Court’s fee schedule.
Massachusetts does not require an attorney for probate, though many families use one for anything beyond a small, simple estate.
