Key Assets: Harnett County is genuinely named for CORNELIUS HARNETT, one of North Carolina’s most consequential Revolutionary War statesmen, whose story connects directly to the Halifax Resolves – America’s first official colonial call for independence – covered in neighboring Halifax County’s file; born in 1723 in Chowan County and raised in the Cape Fear region near Wilmington, Harnett built a career as a respected merchant before becoming a leading voice of colonial resistance following Britain’s 1765 Stamp Act, chairing the Wilmington chapter of the Sons of Liberty and leading street protests against British authority; at North Carolina’s Fourth Provincial Congress in Halifax, Harnett chaired the very committee that produced the Halifax Resolves in April 1776, and he went on to serve as a North Carolina delegate to the Continental Congress from 1777 to 1779, where he personally signed the Articles of Confederation; the county itself was formed from Cumberland County in 1855 in his honor, and today the local mascot for North Carolina’s America250 semiquincentennial commemoration, playfully nicknamed “#FlatCornelius,” is based directly on Harnett; the county is also home to Campbell University, founded in 1887 by Baptist minister James A. Campbell as Buie’s Creek Academy in the small community of Buies Creek, and formally chartered as a university in 1979 – today one of the largest private universities in North Carolina; outdoor enthusiasts also visit Raven Rock State Park, established in 1970 along a dramatic 150-foot rock formation overlooking the Cape Fear River, offering camping, hiking, horseback trails, fishing, and canoeing
Notes: Harnett County’s genuine connection to Cornelius Harnett – chair of the committee behind the Halifax Resolves and a signer of the Articles of Confederation – ties directly to some of the most significant Revolutionary-era history found in this project.

About Harnett County
Harnett County occupies a strategic position between two of North Carolina’s major population centers: the Research Triangle (Raleigh) to the north and Fayetteville (home of Fort Liberty/Fort Bragg, the Army’s largest installation) to the south. This positioning has made it one of the state’s fastest-growing counties as residential development spreads from both directions along I-95 and US-401. Dunn and Angier are the county’s primary commercial communities serving this growth.
Campbell University, a private Baptist institution in Buies Creek with strong law, pharmacy, and business programs, anchors the county’s educational economy. The county’s agricultural heritage – tobacco, cotton, soybeans – persists in its rural townships while suburban development accelerates in the northern communities closer to Wake County.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Harnett County Clerk of Superior Court – Estates Division 301 W. Cornelius Harnett Blvd, Suite 100, Lillington, NC 27546 (910) 814-4400 Harnett County is in south-central North Carolina, seated in Lillington.
Step 1: figure out which path applies
North Carolina has NOT adopted the Uniform Probate Code. Probate is handled by the Clerk of Superior Court – an elected official who serves as the ex officio judge of probate – in the county where the decedent was domiciled, under Chapter 28A of the North Carolina General Statutes. Unlike most states, North Carolina does not have a separate probate court; the Clerk’s Estates Division handles all wills, estates, and guardianship matters.
Affidavit for Collection of Personal Property of Decedent (“collection by affidavit,” N.C. Gen. Stat. § 28A-25-1 and § 28A-25-1.1) – available when the decedent’s personal property, less liens and encumbrances, does not exceed $20,000, or $30,000 if the surviving spouse is the sole heir and receives all property covered by the statute. Filed at least 30 days after death, using Form AOC-E-203B. Real property CANNOT be transferred through this process. If the decedent left a will, the will must first be admitted to probate and a certified copy attached to the affidavit.
Summary Administration – an abbreviated procedure available only when the surviving spouse is the sole heir.
Full Estate Administration – required for larger or more complex estates; the personal representative (called “executor” if named in a will, “administrator” if intestate) is appointed by the Clerk and receives Letters Testamentary or Letters of Administration.
Step 2: filing for administration
File the will (if any) and a petition with the Clerk of Superior Court, Estates Division, in the county where the decedent was domiciled.
The Clerk appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors; North Carolina’s creditor claim period is typically at least three months from first publication.
The personal representative inventories the estate’s assets, pays debts and expenses, and distributes the remaining assets according to the will or North Carolina’s intestacy law, reporting back to the Clerk at key stages.
The estate is closed once a final accounting is filed and approved by the Clerk.
What it costs
Filing fees for full estate administration generally follow the statewide statutory schedule, which scales with the estate’s value.
North Carolina repealed its state estate tax in 2013. There is no state estate tax and no state inheritance tax – only the federal estate tax could apply, and only to very large estates.
