North Carolina County
Northampton County, North Carolina
Roanoke River and northeast Carolina rural heritage - from Northampton County's Roanoke River corridor (the Roanoke River's lower reaches pass through the county's coastal plain terrain, and the river's exceptional shad and herring runs historically supported commercial and subsistence fishing communities along one of the East Coast's most biologically productive river systems) to the county's deep African American heritage and Reconstruction history (Northampton County's African American majority population reflects a history shaped by plantation agriculture and the political struggles of Reconstruction and the Civil Rights era - the county's Black political empowerment during Reconstruction made it a target of violent Redeemer politics, and that history continues to shape the community's identity and civic life).

Key Assets: Northampton County is genuinely defined by the ROANOKE RIVER, a historically significant waterway that forms much of the county’s southern boundary and served for centuries as a primary channel of trade for Native American tribes (including the Tuscarora and Meherrin, who settled along the river alongside the Mattamuskeet and Saponi peoples in the mid-1700s) and, later, for early European colonial settlers; the river’s rich alluvial soil made the surrounding Roanoke Valley a highly desirable destination for early immigrants, and today the river corridor remains a genuine haven for wildlife, supporting black bear, river otter, white-tailed deer, bobcat, beaver, mink, and wild turkey, alongside roughly 200 documented bird species including bald eagles, owls, and osprey, making it a well-regarded destination for birdwatchers; historically, the river carried a variety of names, including “Moratuck” and “Morattico,” before cartographer Edward Moseley formally labeled it “Roanoke River” on his 1733 map; in a significant milestone for North Carolina transportation history, the very first railroad ever constructed into the state – built in 1833 by the Petersburg Railroad Company – crossed into North Carolina near Northampton County, connecting to a trading post on the Roanoke River and opening the region to travelers and commerce from Virginia and points north; during the Civil War, Northampton County was the site of the Skirmish at Boon’s Mill on July 28, 1863, when Confederate troops under Brigadier General Matt W. Ransom successfully defended a critical railroad bridge over the Roanoke River against a Union force intent on its destruction, in a five-hour engagement with relatively few casualties on either side; in more recent legal history, Northampton County was also the named defendant in the 1959 U.S. Supreme Court case Lassiter v. Northampton County Board of Elections, a significant voting-rights case in which the Court held that literacy tests, when applied equally regardless of race, did not on their face violate the Constitution – a ruling that would later be superseded by the Voting Rights Act of 1965’s prohibition of such tests
Notes: Northampton County’s genuine, extensively documented ties to the Roanoke River – spanning centuries of Native American and colonial trade, North Carolina’s first railroad crossing, Civil War history, and a landmark Supreme Court case – are presented here factually and evenhandedly.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Northampton County Clerk of Superior Court – Estates Division 9467 NC Highway 305 (mail: P.O. Box 217), Jackson, NC 27845 (252) 534-1631
Northampton County was founded in 1741, named for James Compton, 5th Earl of Northampton, in northeastern North Carolina, seated in Jackson (though Gaston is the county’s largest community). The Northampton County Courthouse Square, with its 1858 Greek Revival courthouse, is listed on the National Register of Historic Places.
Step 1: figure out which path applies
North Carolina has NOT adopted the Uniform Probate Code. Probate is handled by the Clerk of Superior Court – an elected official who serves as the ex officio judge of probate – in the county where the decedent was domiciled, under Chapter 28A of the North Carolina General Statutes. Unlike most states, North Carolina does not have a separate probate court; the Clerk’s Estates Division handles all wills, estates, and guardianship matters.
Affidavit for Collection of Personal Property of Decedent (“collection by affidavit,” N.C. Gen. Stat. § 28A-25-1 and § 28A-25-1.1) – available when the decedent’s personal property, less liens and encumbrances, does not exceed $20,000, or $30,000 if the surviving spouse is the sole heir and receives all property covered by the statute. Filed at least 30 days after death, using Form AOC-E-203B. Real property CANNOT be transferred through this process. If the decedent left a will, the will must first be admitted to probate and a certified copy attached to the affidavit.
Summary Administration – an abbreviated procedure available only when the surviving spouse is the sole heir.
Full Estate Administration – required for larger or more complex estates; the personal representative (called “executor” if named in a will, “administrator” if intestate) is appointed by the Clerk and receives Letters Testamentary or Letters of Administration.
Step 2: filing for administration
File the will (if any) and a petition with the Clerk of Superior Court, Estates Division, in the county where the decedent was domiciled.
The Clerk appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors; North Carolina’s creditor claim period is typically at least three months from first publication.
The personal representative inventories the estate’s assets, pays debts and expenses, and distributes the remaining assets according to the will or North Carolina’s intestacy law, reporting back to the Clerk at key stages.
The estate is closed once a final accounting is filed and approved by the Clerk.
What it costs
Filing fees for full estate administration generally follow the statewide statutory schedule, which scales with the estate’s value.
North Carolina repealed its state estate tax in 2013. There is no state estate tax and no state inheritance tax – only the federal estate tax could apply, and only to very large estates.
