Key Assets: Noble County’s seat, Perry, was genuinely founded literally overnight on September 16, 1893, during the Cherokee Strip Land Run (also called the Cherokee Outlet Opening) – the fourth and largest of Oklahoma’s five historic land runs; over 100,000 land-hungry settlers, arriving by horse, train, wagon, and on foot, raced at noon that day to claim just 40,000 available homesteads and town lots across roughly six million acres the Cherokee Nation had sold to the federal government for $8,505,736, or about $1.40 per acre; oral tradition holds that a nervous soldier’s rifle discharged five minutes early, at 11:55 a.m., unofficially kicking off the race; today, Perry’s Cherokee Strip Museum and Rose Hill School – an Oklahoma Historical Society affiliate built in 1968 through the Cherokee Strip Historical Society, whose earliest collections were informally stored in the basement of the Perry Carnegie Library starting in the 1950s – genuinely houses one of the most extensive collections of original Land Run artifacts anywhere in Oklahoma, including surveying equipment, claim stakes, and handwritten claim documents dated to the actual day of the run; the museum grounds also preserve the 1895 Rose Hill School, one of the state’s most intact original one-room schoolhouses, still standing on its original foundation with period desks and slate boards; the museum offers rotating exhibits and hands-on blacksmithing demonstrations, documenting life in early Oklahoma from the 1893 land opening through the 1930s
Notes: Perry’s genuine origins as an instant land-run “boomtown” and the exceptionally well-preserved Cherokee Strip Museum collection make Noble County one of the most historically vivid counties for Oklahoma land-run heritage found anywhere in this project.

About Noble County
Noble County is north-central Oklahoma’s Cherokee Strip heritage county – Perry’s extraordinary 1893 founding story and the Cherokee Strip Museum document one of the most dramatic episodes of American settlement.
Perry (the county seat, population ~5,000) was founded on September 16, 1893, in the Cherokee Strip Land Run – 25,000 settlers converged on the Noble County area in the largest single-day land rush in American history. Perry’s settlement was so dramatic and immediate that within hours of the starting gun, a city with newspapers, lawyers, and saloons was operating. The Cherokee Strip Museum preserves this extraordinary founding story.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Noble County District Court 300 Courthouse Drive, Perry, OK 73077 (580) 336-5187
Noble County was founded in 1893, named for John Willock Noble, in north-central Oklahoma, seated in Perry. The 1915 Noble County Courthouse is part of the Perry Courthouse Square Historic District, a National Historic Landmark District listed on the National Register of Historic Places.
Step 1: figure out which path applies
Oklahoma has NOT adopted the Uniform Probate Code, maintaining its own probate statutes under Title 58 of the Oklahoma Statutes. Probate cases are handled by the District Court in each of Oklahoma’s 77 counties.
Small Estate Affidavit (58 O.S. § 393) – available when the total value of probate personal property (not counting real estate) is $50,000 or less. At least 10 days must have passed since death. This process skips court entirely: the affidavit is signed, notarized, and presented directly to whoever holds the asset (a bank, for example), along with a certified death certificate. Real estate can never be transferred this way – even a small estate with real property still needs some form of court proceeding.
Summary Administration – available when the total probate estate does not exceed $200,000, or when the decedent has been dead more than 5 years, or lived outside Oklahoma. This is an abbreviated form of probate – still court-supervised, but faster and less expensive than full administration.
Regular (Full) Administration – the standard court-supervised process, required for larger or more complex estates, or wherever real property is involved and the shortcuts above don’t apply. A personal representative (executor or administrator) is formally appointed by the court.
Step 2: filing for administration
A Petition for Probate is filed in the District Court of the county where the decedent resided; if there’s a will, the original is filed with the petition.
The court sets a hearing date and requires notice be given to heirs and interested parties.
The court appoints a personal representative (executor if named in a will, administrator if intestate) and issues Letters Testamentary or Letters of Administration.
Creditors are notified; claims against the estate must be presented within the statutory period.
The personal representative inventories assets, pays valid debts and taxes, and distributes what remains according to the will or Oklahoma’s intestacy laws.
The estate is closed once a final accounting is filed and approved by the court.
What it costs
Filing fees vary by county – check with Noble County directly for current fees.
Oklahoma has a statutory attorney fee schedule for probate, which provides more predictability than states without one.
No state estate tax, no state inheritance tax. Only the federal estate tax could apply, and only to very large estates.
