Key Assets: Logan County’s seat, Guthrie, is genuinely one of the most historically significant towns in Oklahoma – founded literally overnight during the Land Run of April 22, 1889, when the population reportedly swelled to over 10,000 people in a single day, Guthrie served as the capital of Oklahoma Territory and then as the first capital of the State of Oklahoma from statehood in 1907 until the seat of government was controversially relocated to Oklahoma City in 1910; rather than fading after losing its political prominence, Guthrie preserved its extraordinary Victorian-era architecture almost intact, and today boasts the largest contiguous urban historic district in the entire United States – a National Historic Landmark spanning roughly 1,400 acres, 400 city blocks, and more than 2,000 protected buildings; the crown jewel of this preserved townscape is the genuinely massive Scottish Rite Temple, widely described as the largest Masonic temple in the world, a Neoclassical limestone complex completed in 1923 for roughly $3 million; remarkably, the temple actually incorporates the original 1908 Convention Hall, which was built specifically to house the Oklahoma State Legislature and hosted one regular and one special legislative session before the capital moved – when the state government relocated, the city of Guthrie sold the old legislative hall and surrounding Capitol Park grounds to the Scottish Rite Masons, who built their grand temple around and connected to it; guided tours of the temple’s ornate interior, including a theater with hand-painted backdrops and a working pipe organ, are offered by Masons several times weekly; downtown Guthrie is also home to the Oklahoma Territorial Museum (housed in a 1902 Carnegie library building), the Oklahoma Frontier Drugstore Museum with its apothecary garden, and several other heritage museums, alongside the historic Pollard Theatre and annual events including well-known 89ers Day land run celebrations

Logan County is north-central Oklahoma’s Land Run heritage county – home to Guthrie, Oklahoma’s first capital, whose preserved Victorian architecture is a direct consequence of losing the capital to Oklahoma City in 1910.
Guthrie (the county seat, population ~11,000) was born in a single afternoon on April 22, 1889 – the Oklahoma Land Run’s most dramatic townsite, going from empty prairie to 10,000 residents in hours. As Oklahoma’s first territorial and state capital, Guthrie built an impressive collection of Victorian commercial and government buildings. When the capital moved to Oklahoma City in 1910, Guthrie’s growth stopped – inadvertently preserving the architectural fabric that makes it Oklahoma’s finest Victorian townscape.

Logan County was founded in 1890, named for John A. Logan, in central Oklahoma (part of the Oklahoma City metro area), seated in Guthrie. The 1907 Logan County Courthouse, Classical Revival in style and part of the Guthrie Historic District, is listed on the National Register of Historic Places.
Step 1: figure out which path applies
Oklahoma has NOT adopted the Uniform Probate Code, maintaining its own probate statutes under Title 58 of the Oklahoma Statutes. Probate cases are handled by the District Court in each of Oklahoma’s 77 counties.
Small Estate Affidavit (58 O.S. § 393) – available when the total value of probate personal property (not counting real estate) is $50,000 or less. At least 10 days must have passed since death. This process skips court entirely: the affidavit is signed, notarized, and presented directly to whoever holds the asset (a bank, for example), along with a certified death certificate. Real estate can never be transferred this way – even a small estate with real property still needs some form of court proceeding.
Summary Administration – available when the total probate estate does not exceed $200,000, or when the decedent has been dead more than 5 years, or lived outside Oklahoma. This is an abbreviated form of probate – still court-supervised, but faster and less expensive than full administration.
Regular (Full) Administration – the standard court-supervised process, required for larger or more complex estates, or wherever real property is involved and the shortcuts above don’t apply. A personal representative (executor or administrator) is formally appointed by the court.
Step 2: filing for administration
A Petition for Probate is filed in the District Court of the county where the decedent resided; if there’s a will, the original is filed with the petition.
The court sets a hearing date and requires notice be given to heirs and interested parties.
The court appoints a personal representative (executor if named in a will, administrator if intestate) and issues Letters Testamentary or Letters of Administration.
Creditors are notified; claims against the estate must be presented within the statutory period.
The personal representative inventories assets, pays valid debts and taxes, and distributes what remains according to the will or Oklahoma’s intestacy laws.
The estate is closed once a final accounting is filed and approved by the court.
