Oklahoma County
Pushmataha County, Oklahoma
The Kiamichi Mountains and the Choctaw Nation's remote southeastern Oklahoma - from Pushmataha County's position in the heart of the Kiamichi Mountains (the Ouachita Mountain range's western extension - forested ridges, clear streams, and remote valleys create some of Oklahoma's most scenic and wild landscapes in the least-visited corner of the state) to the county's name honoring Pushmataha (the great Choctaw chief who allied with Andrew Jackson during the War of 1812 and died in Washington DC in 1824 - Jackson called him the greatest Indian he ever knew) and the Sardis Lake reservoir.

Key Assets: Pushmataha County was named for Pushmataha (c. 1764–1824), widely regarded by historians as the greatest of all Choctaw chiefs – one of three regional mingos governing the major divisions of the Choctaw Nation, he served as a U.S. Army brigadier general during the War of 1812 and Creek War, earned the nickname “The Indian General,” and is the only Native American leader buried at Congressional Cemetery in Washington, D.C.; the county seat, Antlers, genuinely earns its nickname the “Deer Capital of the World” – the town itself was built around a popular natural spring where Native Americans and traders once nailed large deer antlers to the surrounding trees as trophies of successful hunts, giving the settlement its name when it was established along the St. Louis and San Francisco Railway in 1886-87; today, Antlers celebrates that heritage with the annual Deer Festival & Outdoor Show, held since 2002 each October with hunting and fishing exhibits, a chili cook-off, live entertainment, and the “Whitetail Wall of Fame”; the Wildlife Heritage Center Museum in Antlers features two 7,000-square-foot deer exhibit enclosures and a 3,100-square-foot log cabin of interactive wildlife exhibits; the town’s historic 1911 Frisco Depot, which ended passenger service in 1958 and freight operations in 1981, now houses the Pushmataha County Historical Society, formed in 1984 and gifted the depot building by Burlington Northern Railroad in 1985 – much of its restoration was completed through donated local labor
Notes: Antlers’ genuine origin story – a spring marked by real hunting trophies that gave the “Deer Capital of the World” its literal name – paired with the county’s namesake, one of the most consequential Choctaw leaders in American history, make Pushmataha County a distinctive piece of southeastern Oklahoma heritage found in this project.

About Pushmataha County
Pushmataha County is southeastern Oklahoma’s Kiamichi Mountain and Choctaw heritage county – one of Oklahoma’s most remote and scenically beautiful communities, named for one of the greatest Choctaw leaders in history.
Antlers (the county seat, population ~2,200) is the commercial hub for one of Oklahoma’s most isolated regions – the Kiamichi Mountains’ forested ridges and clear streams provide exceptional hunting, fishing, and recreation, but geographic isolation has limited economic development.
Sardis Lake – a 14,000-acre reservoir on the Jackfork Creek – provides fishing and recreation in the heart of the Kiamichi Mountains.
Chief Pushmataha – the county’s namesake – led Choctaw forces alongside Andrew Jackson at the Battle of New Orleans and was so respected that Jackson accompanied his funeral procession in Washington DC.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Pushmataha County District Court 203 SW 3rd Street, Antlers, OK 74523 (580) 298-2274
Pushmataha County was created at statehood in 1907 from part of the former Choctaw Nation territory (whose capital was at nearby Tuskahoma), in southeastern Oklahoma, seated in Antlers.
Step 1: figure out which path applies
Oklahoma has NOT adopted the Uniform Probate Code, maintaining its own probate statutes under Title 58 of the Oklahoma Statutes. Probate cases are handled by the District Court in each of Oklahoma’s 77 counties.
Small Estate Affidavit (58 O.S. § 393) – available when the total value of probate personal property (not counting real estate) is $50,000 or less. At least 10 days must have passed since death. This process skips court entirely: the affidavit is signed, notarized, and presented directly to whoever holds the asset (a bank, for example), along with a certified death certificate. Real estate can never be transferred this way – even a small estate with real property still needs some form of court proceeding.
Summary Administration – available when the total probate estate does not exceed $200,000, or when the decedent has been dead more than 5 years, or lived outside Oklahoma. This is an abbreviated form of probate – still court-supervised, but faster and less expensive than full administration.
Regular (Full) Administration – the standard court-supervised process, required for larger or more complex estates, or wherever real property is involved and the shortcuts above don’t apply. A personal representative (executor or administrator) is formally appointed by the court.
Step 2: filing for administration
A Petition for Probate is filed in the District Court of the county where the decedent resided; if there’s a will, the original is filed with the petition.
The court sets a hearing date and requires notice be given to heirs and interested parties.
The court appoints a personal representative (executor if named in a will, administrator if intestate) and issues Letters Testamentary or Letters of Administration.
Creditors are notified; claims against the estate must be presented within the statutory period.
The personal representative inventories assets, pays valid debts and taxes, and distributes what remains according to the will or Oklahoma’s intestacy laws.
The estate is closed once a final accounting is filed and approved by the court.
What it costs
Filing fees vary by county – check with Pushmataha County directly for current fees.
Oklahoma has a statutory attorney fee schedule for probate, which provides more predictability than states without one.
No state estate tax, no state inheritance tax. Only the federal estate tax could apply, and only to very large estates.
