Key Assets: Brule County’s seat, Chamberlain, is genuinely home to “DIGNITY OF EARTH AND SKY,” one of South Dakota’s most visually striking and beloved public monuments, perched on a bluff overlooking the Missouri River between exits 263 and 265 on Interstate 90; the 50-foot-tall, 12-ton stainless steel sculpture, created by South Dakota’s own Artist Laureate Dale Claude Lamphere, depicts an Indigenous woman in traditional mid-1800s Plains-style dress, receiving a star quilt draped across her shoulders – a garment that in Native American culture carries deep symbolic meaning as a mark of profound respect, honor, and admiration; to sculpt the woman’s face, Lamphere drew on the features of three real Native American women from Rapid City, ages 14, 29, and 55, blending them into a single timeless representation; one of the sculpture’s most remarkable design elements is its star quilt itself, composed of 128 individual stainless steel diamond panels finished in shades of blue that catch and shift with sunlight and genuinely ripple with the wind, creating a mesmerizing shimmering effect that has made the statue an instantly recognizable South Dakota landmark, visible to millions of travelers passing along I-90 each year; the monument was a deeply generous $1 million gift to the people of South Dakota from Rapid City entrepreneurs Norm and Eunabel McKie, given in honor of the state’s 125th anniversary of statehood, and was formally dedicated on September 17, 2016, in a ceremony received by then-Governor Dennis Daugaard; in the sculptor’s own words, inscribed on the site’s historical marker, “Dignity” was created to “stand as an enduring symbol of our shared belief that all here are sacred and in a sacred place,” honoring the living cultures of the Lakota and Dakota peoples indigenous to South Dakota; the statue is free to visit and viewable year-round, situated at the Chamberlain Lewis & Clark Welcome Center, and since July 2017, South Dakota residents have even been able to order license plates bearing its image

Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. A separate affidavit exists for South Dakota real estate under $50,000, which must also be filed with the Register of Deeds where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along and no disputes are expected.
Unsupervised Formal Probate and Supervised Formal Probate – for more complex or contested situations.
Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Brule County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings require notice to interested parties and, if contested, a hearing before the circuit judge.
The personal representative gathers and inventories assets, notifies creditors, and pays valid debts and expenses.
After debts and taxes are satisfied, remaining assets are distributed according to the will or South Dakota’s intestacy statutes (SDCL Chapter 29A-2).
