South Dakota County
Buffalo County, South Dakota
Gann Valley and Missouri River breaks - from Gann Valley's distinction as one of the smallest county seats in the United States to Buffalo County's dramatic Missouri River breaks landscape (the county's terrain descends from the Coteau des Prairies plateau into the rugged Missouri River breaks, with grassland coulees, river bottom habitat, and dramatic bluffs creating a remote and scenic landscape where cattle ranching has been the primary land use since the open range era of the 1880s).

Key Assets: Buffalo County is genuinely home to one of the most unusual distinctions in all of American local government – its county seat, GANN VALLEY, is the least populous county seat in the entire United States, with a population of just 10 residents as of the 2020 census; founded in 1885 by settler Herst Gann in a valley along Crow Creek just east of the Crow Creek Reservation, the tiny community became the county seat when Gann personally donated land for a courthouse and fellow settler A.L. Spencer contributed an additional 30 acres to support the fledgling town; the designation briefly moved to a rival community called Buffalo Center in 1886, only to be returned to Gann Valley by 1888, where it has remained ever since; remarkably, the community’s outsized historical significance doesn’t end there – the 2010 U.S. Census determined that the geographic center of population for the entire state of South Dakota fell within Buffalo County, with Gann Valley itself later identified as sitting almost precisely at that statistical middle point of the state; a genuine piece of local architectural history also survives on Gann Valley’s Main Street: the Bank of Buffalo County, a brick Early Commercial-style building constructed in 1921 in the aftermath of a devastating fire that swept through the town’s original wooden storefronts that same year – the building has since served variously as a bank and as the community’s post office, and today stands listed on the National Register of Historic Places; the majority of Buffalo County’s land and population lies within the Crow Creek Indian Reservation, home to the Crow Creek Sioux Tribe, centered in the county’s largest community, Fort Thompson, situated along the Missouri River near the Big Bend Dam
Notes: Gann Valley’s genuine, well-documented status as the least populous county seat in the entire United States – alongside its role at the near-exact geographic center of South Dakota’s population – is one of the most distinctive small-town facts found anywhere in this project.

About Buffalo County

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Clerk of Courts, Buffalo County PO Box 146, Gann Valley, SD 57341 (605) 293-3244
Buffalo County is in central South Dakota, seated in Gann Valley – one of the least populous county seats in the United States. The Buffalo County Clerk of Courts shares office functions with the Brule County Clerk of Court (300 South Courtland Street, Suite 111, Chamberlain, SD 57325) under the First Judicial Circuit.
Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. A separate affidavit exists for South Dakota real estate under $50,000, which must also be filed with the Register of Deeds where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along and no disputes are expected.
Unsupervised Formal Probate and Supervised Formal Probate – for more complex or contested situations.
Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Buffalo County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings require notice to interested parties and, if contested, a hearing before the circuit judge.
The personal representative gathers and inventories assets, notifies creditors, and pays valid debts and expenses.
After debts and taxes are satisfied, remaining assets are distributed according to the will or South Dakota’s intestacy statutes (SDCL Chapter 29A-2).
The estate is formally closed by filing a sworn closing statement or a petition for formal order of discharge (SDCL § 29A-3-1003).
What it costs
Court costs are set by law and paid to the Clerk of Courts; confirm current fees with Buffalo County directly.
South Dakota has NO state estate tax and NO state inheritance tax. Only the federal estate tax may apply, and only to very large estates.
A surviving spouse cannot be disinherited in South Dakota unless the spouse agrees.
