Key Assets: Lyman County is genuinely home to AL’S OASIS, one of South Dakota’s most beloved and enduring roadside institutions, located in Oacoma right on the banks of the Missouri River; the story began in Freiburg, Germany, where a young army officer named Albert Mueller weighed his future between emigrating to South Africa or America – he chose America, and in 1919 he and his wife Dena opened a small grocery store in what was then a bustling cattle town; the business passed down through the family, and in the early 1950s, when the new Highway 16 was built, Albert and Dena’s son Alfred and his wife Veda moved the family business to its present site – a small grocery store with just a ten-stool lunch counter, where Veda personally baked apple pies and fried hamburgers for shoppers and travelers alike; the business has grown many times since, and today Al’s Oasis serves roughly 350,000 orders and 50,000 pieces of homemade pie every single year, along with beef from more than 1,000 cattle annually; genuinely, the coffee is still just five cents, a tradition the family has proudly maintained through every expansion, including a 10,000-square-foot restaurant, bar, and warehouse completed in 1989 and a 17,000-square-foot supermarket, gift shop, and clothing expansion in 2003; a towering bison statue now marks the site for travelers crossing into western South Dakota along I-90; the site itself carries deep meaning that predates the restaurant – in the Lakota language, the area is called Wita Ocokata, meaning “center of the world,” through which the Lakota people believe the Missouri River (Minneshoshe, or “life vein”) flows as a sacred guardian of the land

Lyman County is in central South Dakota along the Missouri River, seated in Kennebec – a town laid out in 1905 that has served as county seat since 1922, with the current courthouse dating from 1925.
Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. A separate affidavit exists for South Dakota real estate under $50,000, which must also be filed with the Register of Deeds where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along and no disputes are expected.
Unsupervised Formal Probate and Supervised Formal Probate – for more complex or contested situations.
Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Lyman County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings require notice to interested parties and, if contested, a hearing before the circuit judge.
The personal representative gathers and inventories assets, notifies creditors, and pays valid debts and expenses.
After debts and taxes are satisfied, remaining assets are distributed according to the will or South Dakota’s intestacy statutes (SDCL Chapter 29A-2).
