South Dakota County
Clay County, South Dakota
University of South Dakota and the Missouri River bluffs - from the University of South Dakota (the flagship university of South Dakota - home to the state's only law school, medical school, and dental school - USD's enrollment of ~10,000 makes Vermillion one of the most university-dominated small cities in the Great Plains, and the Coyotes' Summit League athletics add to the community's identity) to the Missouri River's Clay County bluffs (the dramatic loess bluffs above the Missouri River at Vermillion provide some of the finest elevated river views in the Dakotas, and Spirit Mound - the hill that Lewis and Clark climbed in August 1804 to look for the "little people" described by Native Americans - is preserved as a state historic site).

Key Assets: Clay County is genuinely and remarkably home to the NATIONAL MUSIC MUSEUM, widely regarded as one of the finest and most comprehensive collections of musical instruments anywhere in the world, housed on the campus of the University of South Dakota in Vermillion; the museum’s origins trace to 1966, when Arne B. Larson, a former high school band and orchestra director from Brookings, South Dakota, was hired as a music professor at USD and arrived with a personal collection of roughly 2,500 instruments he had spent decades gathering – his one condition upon accepting the position was simply asking the university whether they had somewhere he could store them; USD offered him space, and Larson’s son André later led the effort to transform that storage space into a proper public museum, formally founded in 1973; today the National Music Museum’s holdings have grown to more than 15,000 instruments spanning American, European, and non-Western traditions across centuries of history, with roughly 1,200 pieces on public display across nine galleries at any given time – the collection includes genuinely extraordinary treasures such as the “Amati King,” believed to be the world’s oldest surviving cello, the “Harrison” Stradivari violin, the world’s oldest playable harpsichord, and the largest Javanese gamelan orchestra found anywhere outside Indonesia, alongside more contemporary pop-culture instruments including guitars once played by Bob Dylan and Elvis Presley; the museum is fittingly housed in the university’s former library building, itself constructed in 1910 with funding from an Andrew Carnegie library grant; the National Endowment for the Humanities’ Chairman Jim Leach has publicly called the institution “a national treasure,” and the museum has been recognized as a finalist for USA TODAY 10Best’s “Best Music Museum” award, placing this small South Dakota college town on the same national stage as far larger cultural institutions
Notes: The National Music Museum’s genuine, extensively documented status as one of the world’s premier musical instrument collections – born from one professor’s personal passion – is one of the most remarkable cultural institutions found anywhere in this project.

About Clay County
Clay County is South Dakota’s flagship university county – USD’s only law school, medical school, and dental school in the state make Vermillion one of the most educationally significant small cities on the northern Great Plains, and Spirit Mound preserves the exact spot where Lewis and Clark climbed for a panoramic Missouri River view in 1804.
Vermillion (the county seat, population ~10,000) is overwhelmingly defined by USD – the university’s professional schools, cultural programming, and research activities give this Missouri River bluff community a cosmopolitan character.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Clerk of Courts, Clay County 211 West Main Street, Suite 200/300, PO Box 377, Vermillion, SD 57069 (605) 677-6756
Clay County was created April 10, 1862, named for Henry Clay, in the southeastern corner of South Dakota, seated in Vermillion – home to the University of South Dakota. The 1913 Clay County Courthouse, Classical Revival in style, is listed on the National Register of Historic Places.
Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. A separate affidavit exists for South Dakota real estate under $50,000, which must also be filed with the Register of Deeds where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along and no disputes are expected.
Unsupervised Formal Probate and Supervised Formal Probate – for more complex or contested situations.
Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Clay County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings require notice to interested parties and, if contested, a hearing before the circuit judge.
The personal representative gathers and inventories assets, notifies creditors, and pays valid debts and expenses.
After debts and taxes are satisfied, remaining assets are distributed according to the will or South Dakota’s intestacy statutes (SDCL Chapter 29A-2).
The estate is formally closed by filing a sworn closing statement or a petition for formal order of discharge (SDCL § 29A-3-1003).
What it costs
Court costs are set by law and paid to the Clerk of Courts; confirm current fees with Clay County directly.
South Dakota has NO state estate tax and NO state inheritance tax. Only the federal estate tax may apply, and only to very large estates.
A surviving spouse cannot be disinherited in South Dakota unless the spouse agrees.
