South Carolina County
Cherokee County, South Carolina
The Gaffney Peachoid and Cherokee County's peach heritage - from the Gaffney Peachoid (the million-gallon water tower shaped like a giant peach - one of the most famous water towers in America, its realistic peach shape and coloring have made it a landmark on I-85 between Charlotte and Atlanta, featured in the Netflix series House of Cards and photographed by millions of travelers) to Cherokee County's significant peach production (upstate South Carolina's combination of clay soils, elevation, and climate makes it prime peach country - the peach has become the region's most iconic agricultural product, and South Carolina consistently ranks among the top peach-producing states).

Key Assets: Cherokee County is genuinely home to COWPENS NATIONAL BATTLEFIELD, a 842-acre unit of the National Park Service preserving the site of the Battle of Cowpens (January 17, 1781), where Brigadier General Daniel Morgan won a decisive Revolutionary War victory over British Lieutenant Colonel Banastre Tarleton in what is documented as “the only successful double envelopment in the American Revolution” – a critical link in the chain of events that ultimately led to Lord Cornwallis’s surrender at Yorktown later that year; established as a National Battlefield Site in 1929, it remains open daily with a visitor center, battlefield trail, auto loop road, and picnic area; separately, Gaffney is home to THE PEACHOID, a genuinely famous 135-foot, 1-million-gallon water tower built by the Gaffney Commission of Public Works to resemble a peach, honoring the region’s fresh peach industry – the landmark has become a well-known regional roadside attraction and pop-culture reference point; the Cherokee County History and Arts Museum, located on the site of the historic Revolutionary War-era SC Militia mustering grounds, documents the county’s geology, Native American heritage, Revolutionary War history, textiles, railroads, farming, and moonshining traditions; Cherokee County is also near Kings Mountain National Military Park and the Overmountain Victory National Historic Trail
Notes: Cowpens National Battlefield’s genuine, extensively documented status as one of the Revolutionary War’s most tactically significant victories – and its direct role in the chain of events leading to Cornwallis’s surrender – is a nationally important piece of American history.

About Cherokee County
Cherokee County is upstate South Carolina’s Peachoid county – the million-gallon peach-shaped water tower on I-85 is one of America’s most recognized roadside landmarks, and the region’s peach production makes it a genuine agricultural heritage community.
Gaffney (the county seat, population ~12,000) is defined by its peach identity – the Peachoid’s national fame from House of Cards has turned a utilitarian water tower into a tourist destination that draws visitors off I-85.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Cherokee County Probate Court 110 Railroad Avenue (Ground Floor), Gaffney, SC 29340 (864) 487-2583 Cherokee County is in the upstate region of South Carolina, seated in Gaffney.
Step 1: figure out which path applies
South Carolina HAS adopted a version of the Uniform Probate Code, giving it more standardized and generally more streamlined procedures than states with older, common-law-based systems. Probate is handled by a dedicated Probate Court in each of South Carolina’s 46 counties – a separate court of limited jurisdiction, led by an elected Probate Judge (four-year term). The case is filed in the county where the decedent lived. The Cherokee County Probate Court’s mission emphasizes professional and compassionate, unbiased assistance to the public.
Small Estate Affidavit / Collection by Affidavit (S.C. Code Ann. § 62-3-1201) – available when the gross value of the entire probate estate, less liens and encumbrances, does not exceed $45,000 (raised from $25,000 for deaths after May 2025). At least 30 days must have passed since death, and no petition for appointment of a personal representative can be pending anywhere. The successor files a Form 420PC “Affidavit for Collection of Personal Property,” which the probate judge approves and countersigns.
Summary Administration (§ 62-3-1203) – a simplified probate procedure available when the value of the estate passing by will (less liens and encumbrances) is under the statutory threshold, or when the surviving spouse is the sole heir or beneficiary.
Informal Probate – the standard path for the majority of estates. No notices or hearings are required unless demanded by an interested party.
Formal Proceedings – reserved for contested matters: objections to a personal representative’s appointment, will contests, a lost or destroyed will, or declaratory judgments on intestacy. The Probate Judge and Clerks remain unbiased and cannot assist with formal actions; the court recommends hiring an attorney for these.
Step 2: filing for administration
The personal representative (or an interested party) files a petition with the Cherokee County Probate Court where the decedent resided; if there’s a will, the original is filed with it.
For informal probate, the Probate Judge (or a designated staff member) reviews the application administratively; formal proceedings require notice and a hearing.
The court issues Letters Testamentary or Letters of Administration, giving the personal representative authority to act.
The personal representative files an inventory and appraisement within 90 days of qualification, and provides periodic accountings as the court requires.
Creditors are notified; claims not timely presented are barred.
The estate closes with a final settlement – a verified report and proposed distribution served on interested parties and approved by the Probate Court.
What it costs
Filing fees vary; check with Cherokee County directly for current fees.
A personal representative’s bond, when required, must equal one and one-half times the value of the estate’s personal property, though bond can often be waived under certain conditions.
South Carolina does NOT impose a state estate tax or a state inheritance tax. Only the federal estate tax applies, and only to very large estates.
