Key Assets: McDowell County is genuinely home to ANDREWS GEYSER, a remarkable man-made fountain near the town of Old Fort that stands as a monument to one of the most significant railroad engineering achievements in 19th-century America; the geyser was built around 1885 as a dramatic feature of the fashionable Round Knob Hotel, constructed by the Western North Carolina Railroad to mark the scenic “gateway” to the Blue Ridge Mountains for train passengers; engineers dammed a mountain spring and ran a gravity-fed pipeline downhill to create the fountain effect, and at its historical peak the geyser could spray water an astonishing 250 feet into the air, visible to passengers on both sides of the train as it wound through the famous “loops” – an 8.4-mile serpentine stretch of track that climbs the formidable Eastern Continental Divide via 13 miles of rail and seven tunnels between Old Fort and Asheville, a route widely regarded by railroad historians as one of the most significant engineering achievements in the United States at the time it was completed between 1875 and 1879; the achievement carried a genuinely tragic human cost that has only recently begun to be fully acknowledged – much of the grueling, dangerous labor of blasting tunnels and grading track through the mountain was performed by incarcerated laborers, whose contributions and suffering are now formally recognized at a dedicated Incarcerated Railroad Workers Memorial near Old Fort, unveiled in 2021; after the Round Knob Hotel burned down in 1903, the geyser fell into disrepair until wealthy New York banker and philanthropist George Fisher Baker rescued and restored it around 1911, renaming it in honor of his friend Colonel Alexander Boyd Andrews, a North Carolina railroad executive instrumental in building the line; the geyser again fell into neglect after regular rail service through the area ended in the early 1970s, until local residents rallied to have the property deeded to the Town of Old Fort in 1975, leading to its full restoration and rededication on May 6, 1976; today the restored geyser and its surrounding two-acre park remain a popular public attraction, drawing an estimated 200,000 visitors in a single recent year, and the site is annually celebrated at the Mountain Gateway Museum’s Railroad Day festival each September, which includes a trolley ride from the historic Old Fort Depot out to the geyser itself
Notes: Andrews Geyser’s genuine, extensively documented history – spanning a 19th-century engineering marvel, a tragic legacy of incarcerated labor now formally memorialized, and a community-driven restoration – is one of the most historically layered landmarks found anywhere in this project.

About McDowell County
McDowell County is western North Carolina’s Linville Gorge gateway county – the “Grand Canyon of the East” and Lake James provide outdoor recreation in a Blue Ridge community at the crossroads of the mountains and piedmont.
Marion (the county seat, population ~8,000) on the Catawba River headwaters serves as the county’s commercial hub and the primary gateway to Linville Gorge Wilderness – one of the few designated wilderness areas in the eastern United States that provides genuinely remote backcountry experiences.
Lake James – created by Duke Power dams on the Catawba and Linville rivers – provides boating, fishing, and camping in a scenic Blue Ridge setting.
Old Fort (population ~1,000) at the base of the Blue Ridge escarpment is where wagon trains historically stopped to prepare for the difficult ascent – the Mountain Gateway Museum documents this transportation heritage.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
McDowell County Clerk of Superior Court – Estates Division 60 North Main Street (mail: P.O. Drawer 729), Marion, NC 28752 (828) 652-7717 McDowell County is in the foothills of western North Carolina, seated in Marion.
Step 1: figure out which path applies
North Carolina has NOT adopted the Uniform Probate Code. Probate is handled by the Clerk of Superior Court – an elected official who serves as the ex officio judge of probate – in the county where the decedent was domiciled, under Chapter 28A of the North Carolina General Statutes. Unlike most states, North Carolina does not have a separate probate court; the Clerk’s Estates Division handles all wills, estates, and guardianship matters.
Affidavit for Collection of Personal Property of Decedent (“collection by affidavit,” N.C. Gen. Stat. § 28A-25-1 and § 28A-25-1.1) – available when the decedent’s personal property, less liens and encumbrances, does not exceed $20,000, or $30,000 if the surviving spouse is the sole heir and receives all property covered by the statute. Filed at least 30 days after death, using Form AOC-E-203B. Real property CANNOT be transferred through this process. If the decedent left a will, the will must first be admitted to probate and a certified copy attached to the affidavit.
Summary Administration – an abbreviated procedure available only when the surviving spouse is the sole heir.
Full Estate Administration – required for larger or more complex estates; the personal representative (called “executor” if named in a will, “administrator” if intestate) is appointed by the Clerk and receives Letters Testamentary or Letters of Administration.
Step 2: filing for administration
File the will (if any) and a petition with the Clerk of Superior Court, Estates Division, in the county where the decedent was domiciled.
The Clerk appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors; North Carolina’s creditor claim period is typically at least three months from first publication.
The personal representative inventories the estate’s assets, pays debts and expenses, and distributes the remaining assets according to the will or North Carolina’s intestacy law, reporting back to the Clerk at key stages.
The estate is closed once a final accounting is filed and approved by the Clerk.
What it costs
Filing fees for full estate administration generally follow the statewide statutory schedule, which scales with the estate’s value.
North Carolina repealed its state estate tax in 2013. There is no state estate tax and no state inheritance tax – only the federal estate tax could apply, and only to very large estates.
