Key Assets: Burke County is genuinely home to the site of FORT SAN JUAN at JOARA, the very first documented European settlement anywhere in what is now North Carolina – and remarkably, more than 40 years before the establishment of the first permanent English colony at Jamestown in 1607; Joara itself was already a substantial 12-acre Native American town and regional chiefdom of the Mississippian culture, part of a vast Indigenous trade network stretching from the Gulf Coast to the Great Lakes, when in 1566 a Spanish military expedition led by Captain Juan Pardo – dispatched from the Spanish colonial outpost at Santa Elena on present-day Parris Island, South Carolina – arrived and was welcomed into the Catawba River Valley by the Catawba people who inhabited Joara; Pardo’s soldiers constructed Fort San Juan at the site, establishing what archaeologists and historians now recognize as the first European settlement built anywhere within the boundaries of modern North Carolina; Pardo left roughly 30 soldiers garrisoned at the fort while he continued his broader expedition of exploration and conquest through the interior Southeast; the outpost’s existence proved short-lived, however – in the spring of 1568, the Native Americans of the region rose up and attacked Fort San Juan, killing the soldiers stationed there and burning the fort to the ground, effectively ending Spain’s brief foothold in the North Carolina interior; more than two centuries later, Burke County played a further pivotal role in American Revolutionary War history: in September 1780, the legendary “Overmountain Men” – a hardy militia of frontiersmen gathered from what are now Tennessee, Virginia, and western North Carolina – mustered at Quaker Meadows in Burke County (at the historic McDowell House, home of Captain Charles McDowell) before marching on to decisively defeat British forces under Major Patrick Ferguson at the Battle of Kings Mountain, a victory Thomas Jefferson himself later credited as “that Turn of the Tide of Success” in the Revolution

About Burke County
Burke County is a North Carolina Blue Ridge foothills county and the 626th most populous in the United States, covering 513 square miles of the Catawba River valley and Blue Ridge escarpment.
Morganton (the county seat, population ~16,000) is Burke County’s largest city – a historic foothill community with a remarkably well-preserved Victorian courthouse square and the Historic Burke County Courthouse (1833, still in use) as its architectural anchor. The North Carolina School for the Deaf and Western Piedmont Community College are significant local institutions.
Broughton Hospital – a major state psychiatric facility in Morganton – has been central to the county’s economy as a significant employer for over 130 years.

Step 1: figure out which path applies
North Carolina has NOT adopted the Uniform Probate Code. Probate is handled by the Clerk of Superior Court – an elected official who serves as the ex officio judge of probate – in the county where the decedent was domiciled, under Chapter 28A of the North Carolina General Statutes. Unlike most states, North Carolina does not have a separate probate court; the Clerk’s Estates Division handles all wills, estates, and guardianship matters.
Affidavit for Collection of Personal Property of Decedent (“collection by affidavit,” N.C. Gen. Stat. § 28A-25-1 and § 28A-25-1.1) – available when the decedent’s personal property, less liens and encumbrances, does not exceed $20,000, or $30,000 if the surviving spouse is the sole heir and receives all property covered by the statute. Filed at least 30 days after death, using Form AOC-E-203B. Real property CANNOT be transferred through this process. If the decedent left a will, the will must first be admitted to probate and a certified copy attached to the affidavit.
Summary Administration – an abbreviated procedure available only when the surviving spouse is the sole heir.
Full Estate Administration – required for larger or more complex estates; the personal representative (called “executor” if named in a will, “administrator” if intestate) is appointed by the Clerk and receives Letters Testamentary or Letters of Administration.
Step 2: filing for administration
File the will (if any) and a petition with the Clerk of Superior Court, Estates Division, in the county where the decedent was domiciled.
The Clerk appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors; North Carolina’s creditor claim period is typically at least three months from first publication.
The personal representative inventories the estate’s assets, pays debts and expenses, and distributes the remaining assets according to the will or North Carolina’s intestacy law, reporting back to the Clerk at key stages.
The estate is closed once a final accounting is filed and approved by the Clerk.
